1 The plaintiff in error, Sam Townley, who shall hereinafter be referred to as the defendant, was convicted in the District Court of Oklahoma County upon an information charging the defendant with the crime of assault with a dangerous weapon. He was tried before a jury who found the defendant guilty, but could not agree upon the punishment and left the same to be fixed by the trial judge, who sentenced defendant to the state penitentiary for a term of eighteen (18) months.
